Swet - Terms of Service

Welcome to Swet (the "App", "we", "us", or "our"). Swet is a swimming-focused social community platform designed exclusively for adults aged 18 years and older. These Terms of Service ("Terms") govern your use of our mobile app, website, and related services (collectively, the "Service").

Please read these Terms carefully before using Swet. By registering an account or using the Service, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

• You must be at least 18 years old to register and use Swet. By creating an account, you represent and warrant that you meet this age requirement.
• If we have reasonable grounds to believe you are under 18, we reserve the right to immediately suspend or terminate your account without prior notice.
• You agree to provide truthful and accurate information during registration and keep your information up to date.

2. Account Registration and Security

• To access certain features, you must register for an account by providing required information such as a valid email address or phone number.
• You agree to provide accurate, complete, and truthful information when creating your account.
• You are solely responsible for maintaining the confidentiality of your login credentials (username, password) and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account or any other security breach.
• Sharing your account or allowing others to use your account is prohibited.

3. User Content and License

• You retain ownership of any content you upload, post, or share on Swet ("User Content").
• By submitting User Content, you grant Swet a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with operating and promoting the Service.
• You represent and warrant that you own or have all necessary rights, licenses, and permissions to grant us the above license.
• You are solely responsible for your User Content and any consequences of posting or sharing it.
• Swet reserves the right (but not the obligation) to remove, edit, or refuse any User Content that violates these Terms or is otherwise objectionable, without prior notice.

4. User Conduct and Community Guidelines

You agree to use the Service only for lawful and appropriate purposes and to comply with the following rules:

4.1 Respect and Safety

• Do not harass, bully, intimidate, threaten, or discriminate against any user based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected status.
• Hate speech, slurs, or offensive language is strictly prohibited.

4.2 Appropriate Content

• Do not post or share any content that is sexually explicit, pornographic, violent, graphic, hateful, or promotes illegal activities.
• No nudity, sexual solicitations, or adult material allowed.

4.3 Privacy and Personal Information

• Do not post personal, confidential, or private information about yourself or others (such as addresses, phone numbers, ID numbers).
• Do not impersonate any person or entity or falsely state your affiliation with any person or organization.

4.4 Spam and Commercial Use

• Do not post spam, advertisements, solicitations, or promote commercial services without prior written approval.
• Avoid repetitive posts or content unrelated to swimming or community interests.

4.5 Legal Compliance

• You must comply with all applicable local, national, and international laws in using the Service.
• Do not upload or distribute copyrighted content unless you own the rights or have permission.

4.6 Prohibited Activities

• Do not attempt to gain unauthorized access to our systems or other user's accounts.
• Do not interfere with the operation or security of the Service.
• Do not use the Service to distribute malware, viruses, or harmful code.

5. Enforcement and Reporting

• We reserve the right to monitor User Content and user activity to ensure compliance with these Terms.
• We may remove content, issue warnings, suspend, or permanently ban accounts that violate these Terms without prior notice.
• Users are encouraged to report violations via the in-app reporting tools or by contacting support.
• Appeals may be submitted but final decisions rest with Swet management.

6. Intellectual Property Rights

• Swet owns all rights, titles, and interests in the App, including its software, design, graphics, logos, trademarks, and content (excluding User Content).
• You may not copy, reproduce, distribute, modify, create derivative works, or publicly display any part of Swet without express written permission.

7. Termination and Suspension

• We may suspend or terminate your access to the Service at any time, with or without cause or prior notice.
• Upon termination, your right to use the Service immediately ceases.
• Termination does not affect any rights or liabilities that have accrued prior to termination.

8. Disclaimers and No Warranty

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee the accuracy, reliability, or availability of the Service or User Content.
• Your use of the Service is at your own risk.

9. Limitation of Liability

• To the fullest extent permitted by law, Swet, its affiliates, directors, employees, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the Service.
• This includes damages for loss of profits, data, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify, defend, and hold harmless Swet and its affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your violation of these Terms or your misconduct.

11. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the country or state where you, the user, reside.
• You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved in the courts or arbitration venues located in your jurisdiction of residence, unless otherwise required by mandatory law.
• Where applicable, you agree to submit to the personal jurisdiction of such courts or arbitration bodies.
• This clause does not prevent us from seeking injunctive or equitable relief in any jurisdiction to protect our rights.

• Continued use of the Service after such changes constitutes acceptance of the new Terms.
